HC rejects Rahul's plea in Sikh row Varanasi court to hear case



Rahul Gandhi, a Congress MP, challenged a decision from the MP/MLA Special Court in Varanasi in a revision appeal that the Allahabad high court dismissed on Friday.

Rahul Gandhi's comments against Sikhs during his September 2024 visit to the US are at issue in this case.

Rahul had challenged in his petition the Varanasi Special Court's ruling to accept a complaint against him.

On November 28, 2024, the court dismissed Gandhi's FIR complaint, stating that since the alleged speech was delivered in the United States, it was outside of its jurisdiction.

A Varanasi resident named Nageshwar Mishra had filed an application with the ACJM, Varanasi court.

On November 28, 2024, the court heard the case and denied the application to register a formal complaint against Rahul, stating that since the speech was delivered in America, it was outside of its purview.

Mishra, a Varanasi resident, attempted to make a formal complaint against this comment with the Varanasi police station's Sarnath police station, but was unsuccessful.

As a result, he applied to the district court to record a formal complaint against Rahul Gandhi.

In September 2024, Gandhi purportedly stated that the Indian environment was unsuitable for Sikhs during a program in America.

His remarks were criticised for being inflammatory and polarising in society.
