The Ladakh administration notified the Supreme Court that due process of law was followed, including telling him about the grounds for his arrest and allowing him to contact his relatives in jail, in response to protests made by activist Sonam Wangchuk's wife against his detention under the National Security Act. Additionally, it told the court that he was medically fit and not being held in solitary prison as claimed.
Leh district magistrate Romil Singh Donk stated in an affidavit submitted to the Supreme Court that Wangchuk was receiving legal counsel and support while incarcerated in order to prepare his appeal to the advisory board against his detention.
"First of all, the replying respondent refutes the flimsy claims in the petition that Sonam Wangchuk has been unlawfully detained and is receiving inappropriate treatment while in jail.
In this respect, it is argued that he has been legitimately detained by a legitimate authority through an order issued pursuant to Section 3(2) of the NSA," the affidavit stated.
It stated, "I (DM) came to pass the order of detention after duly considering the material placed before me, as required by law, and after reaching a subjective satisfaction on the circumstances that prevailed within the local limits of the jurisdiction where he had been engaging in activities detrimental to the maintenance of public order, the security of the State, and services essential to the community as mentioned in the grounds of detention."
According to him, the activist was "fully informed of the facts of his transfer to the Jodhpur Central Jail as well as the fact that he was being held under the Act."
His wife, Geetanjali Angmo, was also promptly informed of the aforementioned truth by telephone by the SHO of the Leh police station.
In an affidavit, the Jodhpur jail administration also stated that Wangchuk had met his brother and wife, as well as his preferred attorney.
It stated explicitly that the detainee is not in solitary confinement because, according to Rajasthan Prison Rules, he is entitled to all privileges granted to detainees, which are not granted to those in solitary confinement.
The affidavit stated, "It is important to note that the detaine is in totally normal health and is also eating a normal diet, regularly consuming morning tea, breakfast, evening tea, and dinner every day since his detention."
